HOW TO GET THE BEST MEDICAL CARE IN YOUR WORKERS' COMPENSATION CLAIM
If you are injured as a result of a work-related accident or incident, knowing the ins and outs of how to get the best medical care for your injury is one of the most important bits of knowledge you can obtain for your Workers' Compensation case.
As many of you know, the laws in the state of Kansas provide that the Workers' Compensation insurance company or employer gets to choose initially who your physician may be for your work-related injury. If you notify them of a work-related injury and the employer does not send you to a specialist, then you may not be getting the best medical attention or care. Some injuries can cause a pain into your arms or legs and you need to see a neurosurgeon or orthopedic surgeon as soon as possible for these types of symptoms. Always ask the doctor that you are being sent to by your employer what their specialty is, and if it isn't a specialty that specifically addresses your injury, you may want to talk to your family doctor or your Workers' Compensation attorney about what type of specialist would be best suited for treating your particular type of injury.
If at every appointment you attend with the appointed Workers' Compensation doctor a representative of the company attends that appointment, be wary of interference by that company representative. Many times, insurance companies will have nurse case managers attend your appointments with the Workers' Compensation doctor. This is a sign that the insurance company or employer is getting the nurse case manager or representative to convince the doctor that you either, (1), don't need to be off work as long as you are or, (2), that you don't need medical treatment that the doctor may be wanting to suggest. Any time a representative is forced upon your medical case, you need to talk to a Workers' Compensation attorney about what you can do to exclude that medical representative.
If your Workers' Compensation doctor does not provide treatment of injuries because you are not getting better with that doctor's treatment, you need to get a second opinion from another doctor using your unauthorized medical, which will let you choose the doctor for the second opinion and let me use that unauthorized $500 to get that second opinion because I know which doctors will fairly evaluate and give comprehensive treatment recommendations that often will benefit my clients in their request to change the Workers' Compensation doctors away from their current doctor.
If the company doctors tell you they are working only on behalf of the company, let that be a sign for you that you need to get away from that doctor. A doctor that tells you that they are only going to do what the insurance company or employer tells them to do and that they are working for the insurance company or the employer is obviously not in your best interests. Many of these types of doctors will release the injured employee back to work sooner than they really should be released and without adequate medication and diagnostic testing because those things are very expensive. I urge you to get that request honored.
In most Workers' Compensation claims in the state of Kansas, a person who has an attorney, generally speaking, gets more attention and care than individuals without attorneys. The thing that is important to understand is that with a careless or carefree and insincere company doctor, you can be in trouble of loosing your health and thus your job.
