SPECIAL REPORT
LOSING YOUR JOB IS NOT THE END OF YOUR WORK COMP CLAIM
If you have properly filed your paperwork for your workers' compensation claim, you do not have to be worried about whether you are entitled to continue to receive work comp benefits if you lose your job. Losing your job will only affect benefits as follows:
1. Weekly workers' comp benefits called TTD may be paid to you even if you no longer have a job. As a matter of fact, if you lose your job, this fact may make you qualified for weekly benefits if your condition is temporary and you are limited in your ability to work. See a workers' comp lawyer if you get into this situation because you will need one to get weekly benefits if they don't volunteer this benefit.
2. Medical treatment is generally not affected at all by a loss of your job. Your employer can go out of business and you are still eligible for medical treatment to be provided and paid for by the work comp insurance company for your employer. If an employer or insurance company says you are not entitled to medical care because you don't work there anymore, you need to get an attorney right away to fight this.
3. Depending on the facts of your case, losing your job could actually make the value of your workers' comp case better. You could be eligible for a work disability that could result in a settlement or award that is worth 5 to 10 times as many dollars than if you were still employed by your company. If you are without employment and you have a work related injury, you will need to prove that you are eligible for this enhanced benefit called a work disability and you should seek the assistance of a workers' compensation lawyer as soon as possible.
4. NEVER QUIT YOUR JOB WITHOUT ADVICE OF A LWYER WHO HANDLES WORKERS' COMPENSATION CLAIMS. QUITTING YOUR JOB WITHOUT GOOD CAUSE CAN CAUSE YOU TO LOSE CERTAIN BENEFITS, SO DON'T DO IT UNLESS AND UNTIL YOU HAVE BEEN TOLD BY YOUR LAWYER IT IS OKAY THAT YOU QUIT.
Losing your job is not the end of your case and getting increased benefits can result. Don't hesitate to get all benefits you are entitled to and get a free consultation with an attorney who concentrates their practice in handling workers' comp claims.
