You should consider getting a new doctor in your auto accident case when:
1. Your treating doctor is not qualified to handle your type of injury case and you need a specialist for your specific injuries. Always consult with your attorney as to when you should make this decision and who you should hire as a specialist because there are some specialists that are not very "special" and you should avoid.
2. Your doctor is not really providing any effective treatment and is only doing or saying the same thing over and over again in each appointment. Your condition should steadily improve or your doctor should be able to tell you why it isn't improving and what alternatives there are for your condition. If your doctor can't or won't tell you why you're not improving or what else can be done then you may need a new doctor or a second opinion.
3. Your doctor's communication with your insurance company or any insurance company is better than their communication with you. If you find out that your doctor is unwilling or unable to communicate with you about your condition and your auto accident injury case specifically then you may need a new doctor. Be patient but demand that your doctor listen and respond in a method that you can understand otherwise you may be in trouble with this doctor and need a new one.
4. If your doctor does not agree with you when they say that your injuries are not accident related, you may need to get a second opinion or just a new doctor. A doctor that won't say that your injuries are accident related when you know that they are is going to torpedo your case in the end and you need to get away from this doctor as soon as possible. A doctor's causation opinion is critical to your case and some doctors don't want to get involved or will rarely say that certain injuries are accident related.
5. If your doctor won't write any reports on your behalf you need to get away from them ASAP. Without a doctor's report regarding your injury and treatment, the value of your claim may be seriously compromised and some doctors just don't like to write reports.
6. If your doctor is someone that is extensively used by the insurance companies to evaluate cases, he or she will not usually write a fair report but will often write it to the benefit of the insurance company. Avoid using insurance company doctors and ask your attorney if your doctor is considered one of those doctors who cater to the insurance industry.
7. Ask your doctor if they will testify on your behalf in a trial or deposition if your case doesn't get settled. No matter how good your doctor's reports or treatment may be if they won't testify on your behalf their support of your claim is worthless and will undermine your attorney's effort to get the most for you in the claim.
8. If you don't like your doctor, neither will the jury and perhaps even the insurance company. If your doctor is an arrogant and unpleasant to you as their patient, they certainly won't be much better to the strangers that evaluate your claim, juries and insurance companies.
9. If your doctor will not refer you out to other doctors and believe they know everything that is best for you that is probably a doctor with an ego that will only hurt your case not help it. You want a doctor that is confident in them so much so that second opinions do not bother them and they welcome the insight.
10. And last but not least, if your doctor will not talk to your lawyer and cooperate with your legal team, the doctor is not going to be helping your case much in getting it settled or tried successfully. Your doctor must be a team player willing to do what is right by you and the legal system so be sure to discuss the with your lawyer how cooperative that doctor may be with your legal team.
